Re: [RC] Duty to Maintain Trails - Barbara McCrary

It wouldn't do much good to complain anyway, as the common answer is "We don't have the money to ......(fill in your preferred issue: rangers, maintenance, whatever)." We DON'T complain, I was just stating a fact about a couple of places that I feel are unsafe. We don't have a problem with them, but some less experienced horses could. As an example of inconsistency, I asked a ranger several years ago why they rebuilt a section of trail to about 6 feet wide at the base of the mountain, and he answered that "Barbara, you need to only 2 feet wide at that particular site.) When I mentioned a hazardous area that might stand some upgrading, he answered, "I've been riding that spot for 20 years and never had a problem with it." Yet some very experienced endurance riders have had problems at that spot. Go figure, as they say. Not griping, just commenting. And I agree that it wouldn't take much pressure from the public regarding liability to have the state shut down parks all together. (" We don't have the money.")

I do need to state that without the liability immunity
I would have no trails to ride on. No landowner in his
right mind would ever dedicate a public trail across his
land if he would be held liable for injuries that occurred on
"his" trail.

Since this statement is as true for public landowners (i.e. the State) as it is for private landowners, please, please, PLEASE let us not complain that the State has no duty to maintain trails so that they are safe. I can think of nothing that is more likely to close trails on public land for all use, than to suggest that the State be held liable for injuries that occur because trails were not "safely" maintained.
