People who tie say that the horse can break its neck if its head is down.  People who don't tie say they want their horse to be able to maneuver in case of accident and that they want them to be able to lower their heads. 
 
I had a friend of mine call me once when the front of the trailer where it attaches to the hitch broke and the trailer sailed over a chain link fence onto a frontage road.  By the time they got off the freeway and to where the trailer was (upside down and crumpled) the mare was gone.  Some kids were there and said there was a horse over behind the apartment building on the lawn and there she was, eating happily.  She had a scrape on the top of her head and on the top of her rump.  When I came to get her, she looked at my little two horse slant load like you want me to do what?  Then she just calmly walked in.  Her owner (contrary to state law) rode in the manger to make sure she was all right.  Amazing.  But.............I don't know if she was tied in or not..............mb
