Re: [RC] re: recruiting vets - Truman PrevattI think this is a fairly sticky issue. In reality the AERC "has no dog in the fight." Ride managers are independent of the AERC. The AERC will sanction rides based on the assumption that the ride manager will run rides under the regulations laid out in the rules and bylaws. For this sanctioning the ride manager is charged a fee. For this fee the AERC counts the ride as an official sanctioned ride with all the rights associated with such. The vet is an employee of the ride manager - not the AERC.The issues between rider and vet are not issues of the AERC unless it is a clear case of "unsportsmanlike conduct" or some other rules violation. The fact a law suit was filed does not imply unsportsmanlike conduct in and of itself. The fact the insurance company settled could be taken as an admission that the case had sufficient merit not to fight it. In any case that is between the rider, vet and the vet's insurance company - not the AERC. I fear if the AERC stuck its nose in the mix - they might end up on the wrong end of a law suit. In reality the AERC has shown little interest in leveling sanctions of any sort against those who have had horses die at endurance rides. To do so in this case could be viewed as harassment. If you are going to sanction one person for a horse death - you need to sanction all. If you don't sanction all you cannot pick out one because he/she chose to seek legal redress. In my opinion, the AERC could not have prevented the lawsuit, but they "should" support ride managers who banned the rider and they "should" consider their own sanctions of riders who sue vets or ride management.
