The ATV flipped and killed the kid. Not only does a child have to wear a seat belt - in most states they have to be in the back in a child restraint seat until 60 pounds and then in a seat belt after that. Like all such laws they are based on what is good for the population as a whole. Is it good bad or indifferent - I don't know? However, if there is an incident as you point out a DA with a set of fangs can make your life pretty miserable.
