The question gets right back to how would such an incident be viewed by a "jury of peers" as to the risk to the AERC and the responsibility of the BOD to deal with the risk. ... and thus the reason why the AERC should leave *total* responsibility where it belongs... with the *Parent*. Except that is not where the total respsonbility lies, and I do not believe that there is a jury in America that would rule that the AERC has no responsibility if a young child is injured on an AERC sanctioned ride. The parent, the ride manager, and the AERC are ALL responsible. We cannot change that by just burying our heads in the sand and saying "it's all the parent's responsibility." I've seen several people speculate that the AERC would have more liability if it had an age limit, but I have seen no opinion on this from an attorney experienced in child-injury cases (and I don't believe it). Perhaps if we are going to use that rationalization as a crutch to avoid our moral responsiblity, the AERC should at least consult such an attorney and get such an opinion, in writing?
