Meaning that young, healthy horses will potentially go to slaughter too - lots of them. That's the part that is most disturbing to me. So, if they are crippled, rank, or otherwise unsuitable for adoption, they should be held in holding pens until they are 10 years old? I notice that it says "at least" three times--so it is not a strict "three strikes and you're out" sort of thing. Looks like there is plenty of wiggle room in there for those in charge of adoption to say, "Hey, this is a perfectly sound and loveable youngster, we will hang on for awhile until the right person comes along." But for the ones such as one poster described, with the noodle legs and the club feet, if they are passed over for adoption for such reasons, they don't have to spend the rest of their lives crippling around a pen. The only other alternative, since there are not enough adopters, and since there is a steady supply of new horses that need to be brought into the facilities, would be to build more and more holding pens, for which there is neither money, nor labor to staff them and care for the animals.
