This is the crux of the problem here.  You state in one breath that the legal
threshold limit is zero and in the next breath that the AERC reviews the test as
so as not to penalize riders who inadvertently have traces ...

Either it is zero or it is not zero.  If it not zero, then the written rule
should reflect this.  The AERC members have a right to know what the real levels
are.  The BOD should not be playing "I've got a secret" on this issue.
