I think you read some bad information. For everyone's safety it is
always better to let others know your horse might kick.  As far as
being sued, you have the defence of saying you had the flag in the
tail for warning! If somebody rides into your horse's kicking range,
it's their own fault. I like the way you handled your horse's kicking
problem though.
