[RC] Lawsuit Question - k s swigartAngie Fura said: Just curious,?if a RM was sued and found "guilty," would the RM's ?AERC insurance policy through Equisure?pay?or could the RM also ?be personally?liable?? I am assuming that you are talking about being found "at fault" (a civil matter) and not actually found "guilty" (a criminal matter), and if so.... If the AERC insurance policy DOESN'T cover the incident (assuming that the suit was for something in connection with the RM's role as ride manager of an AERC sanctioned ride), then it is a piss poor insurance policy. Personally, I have not read the policy...but maybe I should before I manage a ride again, since, to be honest, I don't really know if it covers it, and I suppose I don't really have enough faith in the abilities of the person who negotiated the policy to be sure that it would. If so, would their home owner's policy pick up the tab?? Probably not, and almost certainly not if you charge an entry fee, since most home owner's policies cover you for personal liability, and charging a fee for an event you manage would put you in the realm of acting in a professional capacity. kat Orange County, Calif. :) =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=- Ridecamp is a service of Endurance Net, http://www.endurance.net.
