Re: [RC] Trail fees illegal? - Truman PrevattActually it only applies in the jurisdiction of the particular judge. The FS can still charge for trails in for example the Hoosier National Forest. It can also be appealed. Clearly public land is public land. However, that doesn't mean that any person has absolute authority or absolute use of the lands. Nor does it mean that all activities can be done without a fee. The NFL football game is interesting. Most NFL stadiums are built with public funds and "belong to the public." However, that does not give someone the right to go use them without charge. When I did the Hoosier Daddy ride in '04 we had to pay a trail access fee (and wear a tab on our bridle) - the fee going to the Hoosier National Forest. I find that completely appropriate. I would, however, expect that if there is a fee for activities then a large portion of those fee monies would go back into improvements to support those activities, e.g. fees collected on trail use should go back into trails.
