Actually, an unentered MEMBER could easily be censured--for causing another rider to be in violation of 6k.  The only leverage we have against non-members is appealing to their unwillingness to injure a friend's ability to complete.

An unentered non-member is impossible to censure under AERC rules.  An
unentered member also would be impossible to censure in this situation.
There is nothing in the AERC's rules that says AERC members are not
allowed to ride on public trails unless entered in a ride.
