I had read, probably here, about this waiver you mention where the parents will pay if the child sues. So I asked my lawyer about it and he said that the parents will just say they didn't understand it and if they don't have the money it all still falls back onto me. Then he told me to just have good insurance! LOL It seems no matter what we do we are scr*#ed. If the new law that Oregon passed about strengthening waivers really works, I hope Texas will follow suit. -----Original Message----- From: Carolyn Burgess [mailto:carolyn@xxxxxxxxxxxxxxxxxxxx] Sent: Saturday, September 17, 2005 5:49 AM To: Sandra Walker; ridecamp@xxxxxxxxxxxxx Subject: Re: [RC] RE:[liability and neighborhood kids?] This is where a good liability waiver can really protect you. A kid can't sign for themselve, and a parent cannot sign away a kids rights, for the reason below, but what you can do is write your waiver so that the parent agrees, should you be sued by your child or anyone else as a result of their childrens activities at your place, that they will do whatever is necessary to defend any suit brought against you. This is why it is worth spending a few hundred dollars to have a good lawyer write a good release. It is also one of the reasons that the only kids I let ride my horses are my children and now grand kids.
