Re: [RC] Kids and Riding - Liability? - heidi

As far as letting small children ride (or not), would AERC be
responsible and possibly sued if something were to happen? Would the
organization be responsible legally if there was an incident, God
forbid?

I am not an attorney, but we have had attorneys post on this very subject
in years past. My understanding is that we might actually have MORE
liability if we DO state a minimum age, because the minimum age implies
that children of that age and older are competent to ride. If we have no
stated minimum, there is no such implication.

Would it be possible
to let the ride manager decide on a per-ride basis if they want an age
restriction?

AERC already allows individual rides to have rules that are more stringent
than those of the organization, provided they are made clear prior to the
time of entry. Tevis is one example of a tougher-than-average ride that
imposes a junior age restriction.
