RE: [RC] selling a horse on a trial basis - how to best handle a Purchase Agreement? - Melissa AlexanderWrite out a contract that specifies the terms of the trial period, the terms of the horse's maintenance, and who pays each cost, routine and not routine. Who pays or what happens if the horse gets injured, becomes ill, or dies during the trial period? Who makes the decision about what happens, what treatments are chosen, and so forth in the above situations? It probably ought to be the person paying the bills... it wouldn't be very fair for the decision maker to choose something really expensive that the other party had to pay for. Who pays, and makes the decisions for, the horse's routine care during the trial period? For example, if you've been doing some kind of special, expensive shoeing job every month, you might be pretty irritated if the potential buyer changes all that and then doesn't buy the horse. At the same time, the buyer might be irritated to be stuck with the bill!
