I have heard that one thing the courts will look at is evidence of "due process", which as I understand it is having a chance to have your side of the story heard, a chance to have your evidence presented, and careful consideration of the evidence. Of course, that which is considered convincing evidence apparently varies greatly. Some people only believe machines while others tend to also believe other people.
