There are very few places you can pass another horse, and it takes a bit of planning and working together to do so--such as the person ahead finding a spot at a switchback. Even that can be a bit hairy. I am sure that the rider would've pulled over if she could have, but I doubt it was a possibility. Like I said, I wasn't there, but I do know the trail... I believe it is actually grounds for criminal charges--endangerment of a human life-- IF the rider was warned to back off, and IF the witnesses are willing to testify for the rider.IF it was a deliberate act of behavior and was obvious and there WERE witnesses who warned him to back off, and she is wiling to press charges. Not to mention civil case for the loss of a horse. There are "a ACCIDENTS and there are DELIBERATE ACTS OF RECKLESS BEHAVIOR.Like drunk driving--and If it was as deliberate as the witness said he should have to be held responsible for his behavior.
