My neighbor turned us in for our fence. They put
up a tennis court, which is fine since it is their property, but then they
kept coming over my fence into my pasture to get their balls. (Really bad
tennis players) So I put up an 8 foot privacy fence. The county says you can
only put up a 6 ft. fence with exceptions. So I paid my $250 to go before the
zoning board. No lawyers.
He said the fence was ugly, it blocked THEIR view
of MY beautiful horses and it wasn't fair. I said I had a right to protect my
family from people jumping in my yard, possibly getting bit or kicked and then
suing us for all that we owned. I also had a right to protect my very
expensive race horse from entroloths (sp?) that they could get from
chewing on the tennis balls.
OK, so I bedazzled them with B.S. There was no
one there to dispute so I won and got to keep my fence. It was a unanimous
vote from the zoning board. Besides, even though the county said 8 ft
fences were not allowed, it did not require permits to put up fences. That was
the county's bad. And if the fence was not blocking traffic or a safety
hazard, I could keep it.
So I would talk with your neighbor first about
the rules and regulations and does he know he is in violation. Then
contact your zoning and planning board if he wants to be ugly. You may
not need a lawyer.
