I think the terms of any purchase agreement is between the buyer and 
seller. I recently sold a horse that has some "issues" during the 
saddling process. She also has some other eccentricities, although once 
saddled a small child can ride her. I had her new owner sign a release 
that stated all the things I told him about her, and that he agreed to 
take responsibility for her or any possible injury to himself. He has 
since let me know that he really loves her, and she has a good home. 
Once she left my property, that was it. She was his horse. That way YOU 
are protected from incidents or injury to either horse or rider that 
happen away from your control. Also the new owner, or prospective buyer 
is also protected,because you have both signed the agreement which 
spsells out all the things that each of you deem important about that 
particular horse.
