The horses my blacksmith came by were abandoned and the owner owed him rent. So he got a lawyer yada, yada, yada. All he did was send pictures, names and blood samples. The registry wants to keep horses registered and you don't always need the previous owners permission. What is the previous owner is deceased? If there is a contract dispute the seller should notify the registry first. A contract dispute would be the only valid reason for not turning over papers. If the buyer pays cash, the paper must be signed over. There are also legal ways to acquire a horse like my blacksmith did. I bought a Morgan and the previous owner refused to sign his papers over. I paid cash, had a receipt and sent it to the registry with my transfer fee. They advised me they couldn't transfer ownership because the previous owner refused certified mail and other contacts. (He was just being an ass) I advised the registry, they had a copy of my receipt and had cashed my check. I told them to either cough up a registration with my name or send my money back. I got the registration. Yes, there could be another side to the story, but if you can prove who the horse is and that you are the legal owner, you should be able to get it registered in your name. Some how this just dose not sound right to me.  Horses are sold without papers for a reason sometimes.  Also what about horses sold on a contract and the contract is not kept and the papers are never turned over.  There must be a lot more to this than just a blood sample or dna sample.  The last registered owner of the horse must be notified and asked if this is alright.  At this time I must have a dozen papers of horses that I no longer own, of these ther are maby two that I would ok the registry to reissue. JMHO

Call the registry. They are so helpful and even if you don't find the papers you can send hair or blood in to see if it matches any horse you think it is and they will re-issue the papers. It will cost ya though. My blacksmith acquired 4 mares with no papers (he knew their names, but really wasn't sure who was who) and sent pictures and blood samples and the registry got it all taken care of.
