Re: trail preservation...have a question
Pat,
I'm learning about trail preservation and I'm finding that
the rules are changing as we go along. :) My first
reaction is that private land is private land. However,
there is the possibility of an easement clause like what
most home lots have for utilities. Like Teddy said, many
times it's individual state laws that prevail. I wouldn't
build a trail on private land without owner approval, but
that's a personal opinion. Here in Virginia we have some
parks with trails that go through private land in some
places. Sometimes a land owner will fence the entire
property, trail included. Makes it very awkward. The
delicate part is trying to make these land owners our
friends. :)
