From experience, I know that medical insurance carriers will try mightily to
find someone to sue to recoup their losses. When injuries are because of an
accident, they just can't accept that there is no one they can go after.

Why? That is why we carry medical insurance on ourselves. Accidents DO
happen. Who would pay if your horse stepped in a badger hole on a training
ride and gave you similar injuries? Your OWN insurance, that's who.
Someone
blundered into the area that was not anticipated by either management or
riders--someone who didn't have a clue what was going on. Should management
have foreseen that? Maybe. Should the riders have foreseen that? Maybe.
But it's a bit like the elk on the runway example that I gave earlier. A
mountain pilot knows that mountain flying is hazardous, and does what he can
to ensure that such things don't happen, but the elk is clueless and
sometimes one blunders out there despite the fact that you overflew and
thought it was clear. Smash! Are you going to sue the elk?
