AERC rule 3.3 (under the section about rides being open to all equines)
states "An equine which consstitutes a clear danger to other equines
and/or persons may be disqualifie at any time from competition, by the
rid(g)e manager or ride veterinarian."
So ride managers can disqualify them (before the start even) and riders
can them protest if they think that this was uncalled for....and then it
would be up to the protest committee to determine whether the horse could
reasonably be considered a "clear danger"
Personally, I think one could reasonably make the argument that any "known
kicker" is a "clear danger." There is no two ways about it, a kicking
horse is dangerous. However, there are also some people who would (they
believe reasonably) make the argument that any stallion is dangerous (and
many organizations specifically exclude them from their events for this
very reason), but I bring my stallion to endurance rides all of the time
and would hope that he would be judged by HIS conduct on the day rather
than any preconceived notions that somebody may have about my horse.
