Re: Buying a horse-general issues
Addressing the issues brought up (albeit poorly) by the original post...
Exchange of money or written, signed contracts are not required to obtain
and enforceable contracts. A simple exchange of "I promise to sell you this
horse for $2500" with a corresponding "I promise to buy this horse for
$2500" forms a generally enforceable contract.
But, lets get to the crux here. No court is going to force the seller to
actually go through with the sale if the buyer sues and wins on breach of
contract. It just doesn't happen in the vast majority of cases. What will
most likely happen is that the court will award whatever damages the buyer
can prove resulting from the breach of contract (which won't be much...
maybe the vet exam bill). If a deposit had been made, the buyer could get
the deposit back. Basically the court will just put the buyer in the same
financial position she was in before the contract was made.
A more practical approach would be to ask the vet for a refund of the exam
bucks because he should not have provided that information to a third party
without permission from whomever paid for the exam. This last is of course
assuming that the vet did in fact release the results to another person
without permission.
