Nothing tricky about this at all. Penalties differ as to the severity of the
infraction. If you have traces, you get a letter that you are in violation.
That is your penalty. If you have therapeutic levels (subject to review with
the latest info available, so that the rule does not have to change every
three months) your penalty is accordingly more severe. No secrets here at
all. Perfectly open and above board. No different than exceeding the speed
limit--if the cop pulls you over for doing 60 in a 55 zone, you were illegal
but you likely get a warning. If you were doing 80 in a 55, you most likely
will get a ticket and a fine. If you repeatedly do 120 through the school
zone in your neighborhood, you will eventually lose your license. The law
makes differentiations for severity of the infraction all the time, and it is
perfectly legal. The posted limit is still the posted limit. Period.
