Suit filed to halt equestrian event

HARRISBURG (May 8, 1999) - A Creal Springs man has filed a lawsuit against
the U.S.
Forest Service to halt an equestrian recreation event in the Shawnee
National Forest near
Eddyville.
Joe Glisson, a local environmentalist, filed the federal
lawsuit, which alleges that the
horseriders' jamboree known as Ride99, a trailriding event planned
for June 12 and 13 in the
Shawnee, has been approved illegally.
The lawsuit further alleges that USFS District Ranger Dan
Moriarity, also named as a
defendant, approved Ride99 without proper environmental studies of
the impact a large number
of horseriders could have on the Shawnee. Ride99 will be
headquartered at Bear Branch
Campground on Route 145 north of Eddyville.
According to the lawsuit, a Special Use Permit is required of
Ride99 because it charges a
$45 registration fee, legally making it a commercial event. All
commercial events in National
Forests require the issuance of a Special Use Permit, the lawsuit states.
In addition, the lawsuit alleges that former USFS District
Supervisor Louise Odegaard
advised that Ride99 could not be allowed without an environmental
impact study, due to the
special nature of the Shawnee surrounding the horse trails, and a
SUP, because of the event's
commercial nature and consequent lack of a SUP.
A Categorical Exclusion can be granted by the Forest Service in
some instances, but not in
cases where there are steep slopes or erosive soils, threatened or
endangered species, flood
plains, wetlands or municipal watersheds, Congressionally designated
special areas, inventoried
roadless areas, research natural areas or Native American religious or
cultural sites.
The lawsuit claims all of those are present except flood
plains, wetlands or municipal
watersheds and inventoried roadless areas.
It then alleges that Shawnee Trail Conservancy president Bill
Blackorby offered to donate
five percent of the proceeds of the event to the Forest Service to
help fund horse trail
maintenance projects. Afterward, it claims, Moriarity, who has
authority over SUP decisions,
contradicted Odegaard's decision by declaring that the event could
go on as planned without a
SUP, an environmental impact study or a non-commercial group use permit.
The lawsuit concludes by requesting that the Forest Service
prevent Ride99 and other
commercial equestrian events from occuring in the Shawnee until it
has conducted an
environmental analysis, issued a SUP and complied with any other necessary
regulations.
Forest spokeswoman Becky Banker said little comment could be made about the
lawsuit.
"We just got a copy of the complaint, and we haven't completely
reviewed it and consulted
with our attorneys, so it is inappropriate to comment on the complaint at
this time."
