"Fair use" only applies to copyrighted published materials. For example, if 
Joe had written a "letter to the editor" in a local newspaper, the newspaper 
might have had a claim on copyright, but not Joe. If Joe had been interviewed 
on television, the television station might have copyright protection, but 
not Joe. Public utterances are not copyrighted material.
