Help! Auction - Sou Cal!!!!!
Copied from another list:
A bankruptcy trustee has suddenly put the entire remaining herd of 70
purebred Arabian horses belonging to Calvin Weicamp up for auction either
Sunday March 14th or Monday the 15th. I do understand that the sale is
scheduled for 10 am. Which day will need to be clarified tomorrow.
A Bay Shah son and many related horses are in the group including
showhorses.
Were Popeye and Gulliver from this ranch? I seem to recall that they were.
These horses are being sold without papers. The trustrees and the auctioneer
have let interested parties know that they don't give a rats patoot about
whether they will be in violation of California's new law prohibiting the
sale of horses for slaughter.
Any one who wants to try to help stop this atrocity can call the trustee and
give her their opinion. Her phone number is 760 776-4770. Her name is Sandra
Bendon.
This is a public sale. Needless to say, there is slim to no chance that all
of these horses will sell to individuals who will give them homes.
I am not aware of this sale being advertised in the Arab horse fanciers
community.
There is now a reward for information leading to the arrest and conviction
of any one violating the new California law who "knew or should have known"
that the horses sold would go to a slaughterhouse as a result of their
actions. The reward now stands at $30,000.00.
The auctioneer is Jack Pope and Assoc. and his phone numbers are 760
329-1077 and 760 228-4145.
Perhaps he should hear your opinions.
The sale is to be held at 8788 Pigeon Pass Rd, Moreno Valley, CA.
MORE INFO:
California voters passed Proposition 6 by an overwhelming super majority
in November of 1998. Percentage wise, Proposition 6 received more yes
votes than any other ballot measure!
Proposition 6 has now been incorporated into California Penal Code
Section 598(c) which makes it a felony for a person to "possess, to
import into or export from the state, or to sell, buy, give away, hold,
or accept any horse with the intent of...having another person kill that
horse, if the person knows or should have known that any part of that
horse will be used for human consumption."
In the more prominent horse slaughter auctions in the state, the volume
of sales has dropped significantly, as a result of the passage of
Proposition 6. However, California horses are slipping into the horse
slaughter network in more invidious ways. Today, both the Riverside
County Animal Control Department and the Riverside County Sheriff's
Department refused to enforce Proposition 6, or even attend an auction
which Arabian auction experts have identified as an auction where horses
are destined for slaughter.
Under the U.S. Constitution, no Bankruptcy Court, or its officers,
including bankruptcy trustees, are immune from the obligation to comply
with state Penal Codes. The "police power" of the State is supreme, and
controls over the powers of any bankruptcy trustee to willy nilly
violate the law. For example, if a bankruptcy trustee takes possession
of a chemical plan and operates it, the trustee can be criminally
prosecuted if the chemical plant continues to dump toxic chemicals into
the water supply. So too, a bankruptcy trustee, and her staff,
auctioneer and other helpers are bound by Penal Code Section 598(c).
However, attorney and bankruptcy trustee Sandra Bendon [(760) 324-2702]
and her auctioneer Jack Pope [(760) 329-1077] apparently intend to
knowingly violate Penal Code Section 598c on Sunday March 15, 1999.
Ms. Bendon, as bankruptcy trustee, is now the owner of 70 head of
Arabian horses. As of today, she has not bothered to obtain their AHRA
Registration Papers from their former owner, or from the AHRA. As of
today, she had not bothered to try to identify the horses being sold.
Those familiar with the herd say that it was owned by Calvin Weiscamp
(who is powerless to stop the sale). Those familiar with the herd say
that the herd contains many show winners from Santa Barbara. There is
supposedly a Bey Shah son in the herd, as well as Azraff daughters,
Newton bloodline horses, and "a little bit of everything". The horses
range from foals to elderly mares.
Anyone who loves horses, and abhors those who enable it, needs to be at
this auction. Obviously, if you can rescue a horse by buying it, that
is wonderful.
Equally important, even if you cannot buy one, is to come and watch the
auction, and be available to "witness" about this gross violation of
Proposition 6 by government employees who think they are above the law.
Bring a video camera if you can, and video the auction and the people
running it, and if you dare, video the trailer and truck license numbers
of those who have purchased horses. Remember the Rodney King
videos...let's do the same for the horses.
Those in the Arabian community who worked and prayed for the passage of
Proposition 6 will not idly sit by and have this important humane laws
ignored, with impunity by those who consider themselves "above the law".
In violation of Proposition 6, Ms. Bendon and her auctioneer Mr. Pope
intend to sell all of the horses, without reserve, beginning at 10:00AM
on 3/15/99 at the former Weiscamp ranch at 8788 Pigeon Pass Road in
Moreno Valley. There has been virtually no publicity about this
auction, in that Arabian rescue oriented people in Riverside County did
not even hear about it until 3/12/99.
