Some vets have asked me about liability and Prepurchase exams. Seems
that some have been sued for not catching a problem during an exam and
then the owner discovers it after the sale was completed.

The real liability issue is the relationship between the cost of the
exam and the risk of not doing everything medically possible. In other
words, the purchaser and the vet need to discuss the tests that are
available (and the associated costs of each). Then comes the tough
decision of how much to spend. The less you spend, the greater the
risk.

>From a vet's point of view, the easiest answer is to recommend every
test possible and let the purchaser decline. Then the vet is off the
liability hook if things go haywire. Fortunately, most vets have their
feet on the ground and will make solid, common sense recommendations.

So don't forget to consider the value of the horse (and maybe the years
of training you intend to put into it) when deciding how extensive your
prepurchase exam will be. Hope this helps.
