[RC] Horse Sale or Lease Issue Contract - Roger Rittenhouse
I wrote and agreement with the owner of my new horse - pickup on
Monday.
It is a 6 month lease- with option to buy and apply lease to sale
price.
I added prepurchase exam at UT AFTER I take the horse. I would never
trust a vet I did not know- in this case- to perform the full exam I
would be requesting. There was-is no way to get the horse
to UT from Kty for an evaluation without me taking him there.
I also stated suitability for purpose, not just sound etc but suitable
for use as an endurance horse. However I would not be adverse to
signing a statement about the condition of the horse at time of
possession.
The exam will consist of xrays - all 4 wheels- running gear, blood test,
full soundness exam.
My shoer and a trainer-friend is in on the process.
If there was problem, the open ended lease is the way out even if he
failed to come up to my specifications. I could loose the lease
payment and would have to return the horse.
Since I am getting the horse from a reputable breeder and since he has
not done much, I really dont expect any problems or un-disclosed
un-noted issues.
But the lease and final sale is based on the exam and evaluation at
my vet- in this case Univ of TN.
I have the full mortality and accident insurance for the full price-
in the owners name. The cost of 'loss of use' insurance was too high
and this firm will provide that level of coverage on horses under
10K$.
No need to worry there since I surely would not buy a 10K$ horse.
I will know more next week after we get to know each other and then get
to UT within the first week he is here.
The lease agreement says I will be responsible for the care and
maintenance of the horse. The legal words are there that would
protect the seller from me wrecking the horse and trying to return
him.
In the horse sales business nothing is absolute. All depends on the
motivation of the sellers and buyers.
After being burned once with 'a medium dollar' horse, I felt a try it
before I buy it approach is better- this time.
