Regarding the issue of warning people about bad spots in the trail at ride meetings: since not everyone attnds the meetings or hears what is said there, it seems like common sense and CYA (not meaning a Howard-style farewell, but 'cover your tookus') to print out these instructions/warnings along with whatever sort of written waiver form is used for the ride, and have the waiver refer to have read and understood them. It would be a whole lot harder to accuse an RM of negligence if the warnings/caveats were presented in writing.
It's interesting to note that the legal issue with the skiing case was not liability, but the parent's right to sign a waiver on behalf of a minor. Will businesses such as ski-schools, stables, etc stop taking minors as clients to avaid this risk? Hope not.
