That's kind of a good reason to have the wording in the preamble allowing
the RMs to add any particularly context sensitive additional safety
measures to their rides - taking into account the local situations. In NM,
there isn't a great need to specifically require safety gear (from a legal
perspective it would seem) whereas in CA there may be other things to think
about.
The way the AERC rules are now, they don't specifically say you must...but
they do say you may...and they don't say that you can't....does that cover
the bases well enough??
