Judy,
The answer to your questions depends primarily on the contract for the
sale, and whether the owner knew what you wanted the mare for. (I am
assuming you did not ask this specific question and receive a negative
response.)
Down and dirty answer, though, is that you would probably win litigation
for a refund of your purchase price so long as all warranties were not
expressly disclaimed in the contract and assuming the owner knew you wanted
the mare for endurance (since that is similar enough to being on the track to
put her on notice it might effect what you wanted the mare for).
She should refund your money.
