David,
Read about your problem. In a past life, spent alot of time obtaining
legal advice mostly in personnel and human resource type issues.
Anything that employees could do, my batch seemed to do.
My initial reaction to your problem is that unless there is an official
paper trail, it doesn't exist. Meaning that unless predated agreement
prior to your sale can be produced, your sale is final. If you were not
notified of any preexisting verbal contracts at the time of sale, you
can't be held responsible. The seller is in hot water now and theft is a
very real possibility as you surmise.
Julie I. Fershtman is an attorney with a law practice serving the horse
industry. Her expertise also includes business disputes, employment law
and real estate law. She's in practice for 13 years and is on the
national equine speaking circuit. She's at (248) 644-8645. She's an
authority on your problem and whatever the costs, is true legal advice.
Good luck.
Jay Dreschnack.
